Allahabad High Court

UMESHversusSTATE OF U.P.

Decided

Holding

The applicant is entitled to be released on bail.

Summary

The High Court considered a bail application filed by Umesh in Criminal Case No. 171 of 2026, which involves offences under Sections 103(1) and 238 of the Indian Penal Code. The case is based on circumstantial evidence, and the applicant was named as an accused during investigation along with co-accused Mohit. The court noted that Mohit had already been released on bail in a similar proceeding and that Umesh has no prior criminal record, having been in custody for four months. The State opposed bail but did not dispute the factual submissions. After reviewing the record, the court held that there was no reason to deny bail and ordered the applicant’s release on personal bond and sureties with standard conditions. The order expressly limited its observations to the bail application and did not address the merits of the trial.

Issues considered

  • Whether the applicant is entitled to bail despite the case being based on circumstantial evidence and the existence of co-accused who have been granted bail.
