Allahabad High Court

POONAM DEVIversusSTATE OF U.P.

Decided

Holding

The bail application is allowed and the accused is released on bail subject to conditions.

Summary

The High Court considered a bail application filed by Poonam Devi, who was in custody for offences under Sections 319(2), 318(4), 338, 336(3) and 340(2) of the Indian Penal Code. The applicant contended that she was falsely implicated, that the dispute was essentially civil, and that she had no role in the alleged offences. The opposing A.G.A. opposed bail but did not dispute the applicant's contentions. After reviewing the record and the nature of the allegations, the Court, without expressing an opinion on the merits, found the case suitable for bail and ordered her release on personal bond and two sureties, subject to conditions of appearance, non‑tampering, and non‑engagement in criminal activity. The Court also clarified that its observations were limited to the bail application and would not affect the trial's merits.

Issues considered

  • Whether bail should be granted to the accused in a case involving IPC sections 319(2), 318(4), 338, 336(3) and 340(2) where the accused claims innocence and that the matter is essentially civil.
