Allahabad High Court

JITENDRA @ SHERU AND 2 OTHERSversusSTATE OF U.P.

Decided

Holding

The Court held that bail should be granted to the applicants.

Summary

The Allahabad High Court considered a bail application filed by Jitendra @ Sheru and two others, who were in custody since July 8, 2026 for offences under Sections 305(a), 331(3), 317(2) and 112 of the Indian Penal Code. The applicants claimed innocence, stating the FIR was lodged against an unknown person and that no incriminating material was found on them. The State opposed bail but did not refute the applicants' factual submissions. Weighing the nature of the allegations, the period of custody, and the heavy case pendency, the Court, without expressing a view on the merits, found the case fit for bail. Accordingly, bail was granted subject to a personal bond, two sureties and several conditions to prevent tampering with evidence, intimidation of witnesses, and commission of similar offences. The Court retained the power to cancel bail if any condition is breached.

Issues considered
