Holding
The court held that the applicant is entitled to be released on bail during the pendency of the trial.
Summary
The High Court considered a bail application filed by Gautam, who was implicated in a theft of electric wire case (Criminal No. 135 of 2026) under sections 303(2), 317(2), 317(4), 317(5) and 3(5) BNS. The applicant claimed innocence, stating his name appeared only in a co‑accused's confession and that no incriminating material was recovered from him. The court noted that co‑accused had already been released on bail and that the applicant had no prior criminal record, having been in custody since 1 September 2026. Despite the seriousness of the alleged offences, the court found no reason to deny bail given the pendency of trial and the applicant’s willingness to furnish sureties and comply with conditions. Consequently, the bail application was allowed without expressing any view on the merits of the case, subject to standard bail conditions.
Issues considered
- Whether bail should be granted to an accused charged with offences under sections 303 and 317 during the pendency of trial.
- Whether the absence of direct evidence and the applicant's clean criminal record justify bail.
- Whether the bail of co‑accused and the length of pre‑trial detention affect the decision.
