Allahabad High Court

FIROZ @ AJMERIversusSTATE OF U.P.

Decided

Holding

The Court granted bail to the applicant, subject to conditions.

Summary

The High Court considered a bail application filed by Firoz @ Ajmeri, who is accused in Crime No. 7 of 2026 under Sections 305(A), 317(2) and 331(4) of the Indian Penal Code. The applicant contended that he was falsely implicated, was not named in the FIR and has been in custody since 21 January 2026, while a co‑accused had already been granted bail. The State opposed the bail but did not dispute the applicant’s factual contentions. After reviewing the record and the nature of the allegations, the Court, without expressing any view on the merits, found the case fit for bail and ordered release on a personal bond with two sureties and specific conditions. The order also clarified that the observations are limited to the bail application and will not affect the trial’s merits.

Issues considered

  • Whether bail should be granted to the accused under Sections 305(A), 317(2) and 331(4) of the IPC in the circumstances presented.
  • Whether the applicant’s claim of false implication and lack of naming in the FIR justifies the grant of bail.
