Allahabad High Court
NEELESH KUMAR AND 2 OTHERSversusSTATE OF U.P.
- Decided
- Bench
- AVNISH SAXENA
Holding
The Supreme Court’s declaration that the Uttar Pradesh Gangsters and Anti‑Social Activities (Prevention) Act is inoperative renders the detention unlawful, entitling the applicants to bail.
Summary
The Allahabad High Court considered a bail application filed by Neelesh Kumar and two others who were arrested under Section 2/3 of the Uttar Pradesh Gangsters and Anti‑Social Activities (Prevention) Act, 1986. The applicants argued that they were falsely implicated and pointed to their existing bail in other cases and limited criminal histories. The State opposed the bail. The Court relied on the Supreme Court’s decision in Shiv Pratap Singh Alias Chinu v. State of U.P. (2026 SCC Online SC 1677), which held that the Gangsters Act is "still born" and cannot sustain proceedings. Consequently, the Court found no legal basis to continue the incarceration and, without addressing the merits, granted bail subject to a personal bond and sureties, invoking further Supreme Court dicta on bail policy. The applicants were ordered to cooperate with the judicial process for speedy disposal.
Issues considered
- Whether bail can be granted to accused detained under the Uttar Pradesh Gangsters and Anti‑Social Activities (Prevention) Act in view of the Supreme Court’s declaration that the Act is inoperative.
- Whether the applicants’ criminal histories affect their entitlement to bail under the Act.
