Allahabad High Court

AKARAM SHAHversusSTATE OF U.P.

Decided

Holding

The court held that the applicant is entitled to bail during the trial, subject to strict conditions, without expressing any opinion on the merits of the case.

Summary

The High Court of Allahabad considered a bail application filed by Akaram Shah, who was arrested in a case involving alleged offences under several sections of the Indian Penal Code, including 61, 318, 319, 336, 338, 351 and 352. The applicant claimed innocence, asserted that no money was transferred to his account, and had no prior criminal record, while the State opposed bail. After reviewing the record and the seriousness of the allegations, the court concluded that the applicant was entitled to bail during the pendency of the trial, without commenting on the merits. The court ordered his release on personal bond with two sureties, subject to conditions prohibiting tampering with evidence, intimidation of witnesses, and committing similar offences. The bail may be cancelled if any condition is breached. The order was dated 1 October 2026.

Issues considered

  • Whether bail can be granted to an accused charged with offences under IPC sections 61, 318, 319, 336, 338, 351 and 352 during trial.
  • Whether the applicant poses a risk of evidence tampering, witness intimidation, or flight that would justify denial of bail.
