Allahabad High Court

ANILversusSTATE OF U.P.

Decided

Holding

The court held that the applicant had made out a prima facie case for bail and therefore granted bail.

Summary

The High Court considered a bail application filed by Anil, who was arrested in Crime No. 104 of 2025 under Sections 103(1) and 238 of the Indian Penal Code. The applicant contended that he was falsely implicated and that the only eyewitness evidence pertained to a co-accused, Sangeeta, with no direct observation of Anil. The State, represented by the Additional Government Advocate, opposed bail, but the court found the applicant's claim of innocence credible and noted the lack of substantive evidence linking him to the alleged offence. Relying on the principle that bail may be granted when the case is based merely on suspicion, the court held that the applicant had made out a prima facie case for bail. Consequently, the court ordered his release on personal bond and two sureties, subject to standard conditions, without prejudice to the trial on merits.

Issues considered

  • Whether bail should be granted to the accused under Sections 103(1) and 238 IPC when the prosecution's case is based solely on suspicion and lack of direct evidence.
