Allahabad High Court

RAVINDRA PAL ALIAS RAVINDRA PAL SINGHversusSTATE OF U.P.

Decided

Holding

Bail is granted to the applicant subject to the conditions imposed by the court.

Summary

The High Court of Allahabad considered a bail application filed by Ravindra Pal Singh in a 2013 case involving offences under Sections 420, 406, 409, 467, 471 and 120‑B IPC. The applicant pleaded innocence, contended that the allegations were fabricated, and highlighted that the co‑accused had already been released on bail by the same court. The State opposed the bail but did not dispute the co‑accused’s bail status. After reviewing the record and the nature of the allegations, the court, without expressing a view on the merits, held that the case was suitable for bail. Accordingly, the court ordered the applicant’s release on personal bond and two sureties, subject to several conditions regarding attendance and non‑abuse of liberty.

Issues considered

  • Whether bail should be granted to the accused in a case involving serious IPC offences given the co‑accused have already been released on bail
  • Whether there is a risk of flight, tampering with evidence or misuse of liberty that warrants denial of bail

Legislation cited

Subjects

  • bail
  • Indian Penal Code
  • Criminal Procedure Code
  • flight risk
  • co‑accused bail
  • conditions of bail
