Allahabad High Court
YUVRAJ SINGHversusSTATE OF U.P.
- Decided
- Bench
- HARVIR SINGH
Holding
The court held that the applicant is entitled to be enlarged on bail during the pendency of the trial.
Summary
The High Court considered a bail application filed by Yuvraj Singh, who is accused in Crime No. 299 of 2025 under Sections 191(2), 109(1), 352 and 351(2) of the B.N.S. The applicant claimed innocence, stating that the FIR only made a general allegation of firing and did not assign a specific role to him, and that the victim had recovered. The court noted that two co‑accused had already been released on bail and a third had been granted anticipatory bail, and that the applicant had no prior criminal record. After reviewing the nature of the offence, the evidence and the discharge summary indicating the victim’s recovery, the court decided, without expressing an opinion on the merits, that bail was appropriate. The applicant was ordered to be released on personal bond with two sureties, subject to conditions of attending trial, not tampering with witnesses and not engaging in illegal activity. The court also directed verification of the sureties’ identity and residence.
