Allahabad High Court

PRIYANSHU JAISAWALversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court held that the applicant had made out a prima facie case for bail and therefore granted bail.

Summary

The Allahabad High Court considered a second bail application filed by Priyanshu Jaisawal in Criminal Misc. Bail Application No. 41200 of 2025. The applicant argued that he was not named in the FIR, was falsely implicated, and that key prosecution witnesses had turned hostile after cross‑examination. The State opposed bail but could not refute the applicant’s submissions. The Court noted the lack of direct accusation, the hostile witnesses, and the applicant’s clean record, and concluded that prima facie the applicant was entitled to bail. Accordingly, the Court ordered his release on personal bond and two sureties, subject to standard conditions, without prejudice to the trial on merits.

Issues considered

  • What is the appropriateness of granting bail to an accused who is not named in the FIR but is implicated during investigation?
  • Does the turning hostile of key prosecution witnesses affect the bail eligibility of the accused?
  • Can bail be granted under the multiple statutory provisions cited (IPC, POCSO Act, ITPA) despite the seriousness of the alleged offences?
