Allahabad High Court

MOHAMMAD AARSHADversusSTATE OF U.P.

Decided

Holding

The court held that the applicant had made out a case for bail and therefore granted bail.

Summary

Mohammad Aarshad was charged under Sections 69 and 351(2) of the Indian Penal Code for allegedly establishing a relationship with a 20‑year‑old woman by a false promise of marriage and later refusing to marry. He applied for bail during the pendency of the trial. The prosecution contended that he misled the victim, while the defence argued that there is no clinching evidence, the victim is a major, and the alleged consensual encounter was mischaracterised as a crime. The court observed that, without expressing an opinion on the merits, the applicant had made out a prima facie case for bail. Accordingly, bail was granted on personal bond and two sureties, subject to conditions not to tamper with evidence or intimidate witnesses, and the order does not affect the trial on merits.

Issues considered

  • Whether the applicant is entitled to bail under Sections 69 and 351(2) of the IPC given the facts of the case
  • Whether the prosecution has produced sufficient evidence to deny bail
