Bail was not warranted at the stage of recording the accused’s statement under Section 313 Cr.P.C., and the application was rejected.
Summary
The applicant Suraj Kumar filed a bail application in the Allahabad High Court while the trial was at the stage of recording his statement under Section 313 of the Criminal Procedure Code. The status report indicated that the trial was at the “fag end” with the statement recording scheduled for 30 January 2026. The court examined whether bail could be granted at this advanced stage of the trial. It held that since the trial was nearing completion, there was no sufficient ground to grant bail.
