Allahabad High Court

SUNILversusState of UP AND 3 OTHERS

Decided

Holding

The bail application was dismissed as infructuous because the applicant had already been convicted.

Summary

The applicant, Sunil, filed a second bail application in a criminal case (Crime No. 224 of 2022) involving offences under Sections 363, 366, 376 of the IPC and Sections 5 and 6 of the POPCSO Act. The trial court had already convicted him of these offences. The informant’s counsel argued that the bail application was now infructuous because of the conviction, and the Additional Government Advocate raised no objection. The bench accepted that the conviction rendered the bail application moot. Consequently, the second bail application was dismissed as infructuous.
