Allahabad High Court

RAJESH MAHRAversusSTATE OF U.P.

Decided

Holding

The Court held that bail must be granted as the mandatory provisions of Section 52-A were not complied with, establishing a prima facie case for bail.

Summary

The Allahabad High Court considered a bail application filed by Rajesh Mahra, who was arrested under Sections 8 and 20 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act. The applicant claimed innocence, alleged that the recovery was a sham, and argued that the mandatory provisions of Section 52-A of the NDPS Act had not been complied with. The State opposed bail, contending that Section 50 of the NDPS Act was satisfied despite the lapse in Section 52-A compliance. After reviewing the material and hearing both sides, the Court noted the absence of compliance with Section 52-A and, without delving into the merits, found that the applicant had made a prima facie case for bail. Consequently, the Court granted bail on condition of a personal bond, two sureties, and compliance with standard bail conditions, warning that any breach would lead to cancellation.

Issues considered

  • Whether bail can be granted in an NDPS case when the mandatory provisions of Section 52-A of the NDPS Act have not been complied with
  • Whether compliance with Section 50 of the NDPS Act suffices to justify denial of bail
