Allahabad High Court
PRABHA DEVIversusSTATE OF U.P.
- Decided
- Bench
- SAMEER JAIN
Holding
The applicant is entitled to be released on bail.
Summary
The High Court considered a bail application filed by Prabha Devi, who was accused in a case of alleged homicide under Sections 85, 80(2) of the CrPC and Sections 3/4 of the D.P. Act. The applicant, the mother‑in‑law of the deceased, argued that the death was a suicide by hanging and that there were no specific allegations against her, noting that the co‑accused father‑in‑law had already been released on bail. The State opposed bail but did not dispute the factual submissions. The Court, noting the lack of a specific charge, the applicant's clean record, her gender, and the fact that the father‑in‑law had been bailed, held that she was entitled to bail. Without commenting on the merits, the Court ordered her release on bail subject to a personal bond, two sureties and standard conditions, and clarified that the order does not affect the trial's merits.
Issues considered
- Whether bail should be granted to the accused under Sections 85 and 80(2) of the CrPC and Sections 3/4 of the D.P. Act given the circumstances of the case
- Whether the absence of specific allegations against the applicant and the alleged suicide nature of the death justify bail
- Whether the applicant's gender and clean criminal record are relevant factors for bail
