Allahabad High Court
LEELAversusSTATE OF U.P.
- Decided
Holding
The court held that bail is appropriate and allowed the bail application.
Summary
The High Court considered a bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, on behalf of the accused Leela, who was lodged in jail since 25‑01‑2026 for offences including sections 191(2), 191(3), 190, 61(2), 109, 130, 115(2), 352, 351(2), 324(2), 110 BNS and Section 7 of the Criminal Law Amendment Act. The applicant claimed innocence and pointed out that several co‑accused had already been granted bail, arguing that his role was no different. The prosecution highlighted that an 84‑year‑old victim suffered head injuries and that the alleged assault involved many persons, though no specific role was assigned to the applicant. After reviewing the facts and the heavy pendency of cases, the court, without opining on the merits, found the case fit for bail and ordered release on a personal bond with conditions to prevent tampering with evidence or intimidation of witnesses. The bail was granted subject to strict compliance with the stipulated conditions.
Issues considered
- Whether bail should be granted to the accused under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, considering the seriousness of the alleged offences and the injury to an elderly victim.
