Allahabad High Court

AJITversusMRS. SHRUTI, DISTRICT MAGISTRATE

Decided

Holding

The contempt application is consigned to the record as the opposite party has shown compliance and will release the property by 07‑10‑2026.

Summary

Ajit filed a contempt application alleging that the District Magistrate willfully disobeyed an order dated 17‑10‑2025 of the Special Judge (Gangster Act) in Criminal Misc. Case No. 314 of 2023, which directed the release of Ajit's attached property after the appeal period expired. The High Court issued a series of procedural orders requiring affidavits and replies from both parties. The District Magistrate eventually filed an affidavit stating that an order dated 22‑09‑2026 had been issued directing the Sub‑Divisional Magistrate to release the property, subject to the pending criminal appeal (Defective No. 750 of 2026). The court noted that the property would be released by 07‑10‑2026 and, on this basis, consigned the contempt application to the record. The judgment leaves open the possibility of reviving the contempt proceeding if the order remains unfulfilled.

Issues considered

  • Whether the District Magistrate’s alleged failure to release the attached property amounts to contempt of the High Court’s order dated 17‑10‑2025.
  • Whether the filing of a subsequent order directing release of the property, subject to a pending appeal, satisfies the original contemptuous disobedience allegation.
