Allahabad High Court

MOHAMMAD YASEENversusSHRI SATYENDRA KUMAR POSTED AS DISTRICT MAGISTRATE AND 4 OTHERS

Decided

Holding

No case for contempt was made out; the contempt application was dismissed.

Summary

The applicant, Mohammad Yaseen, filed a contempt application against State officials and officials of Nagar Nigam Varanasi, alleging non‑compliance with a notice. The respondent, represented by counsel Bipin Bihari Pandey, submitted that a notice under Section 331(1)(2) of the U.P. Nagar Nigam Adhiniyam, 1959 had been issued but not responded to, and that no demolition activity had been undertaken. The respondent further argued that Nagar Nigam Varanasi was not a party to the earlier writ proceedings and that the contempt petition was premised merely on the issuance of a notice. The Court examined whether a contempt case could arise solely from the existence of an unresponded notice and whether the municipal body could be held in contempt without being a party to the writ. Finding that the allegations did not constitute contempt, the Court dismissed the contempt application.

Issues considered

  • Whether the issuance of a notice under Section 331(1)(2) of the U.P. Nagar Nigam Adhiniyam, 1959, without a response, amounts to contempt of court.
  • Whether Nagar Nigam Varanasi, not being a party to the original writ, can be held in contempt in the present proceedings.
