Allahabad High Court

NARESH KUMARversusRAMCHANDRA MISHRA AND ANOTHER

Decided

Holding

The contempt application is dismissed as infructuous because the complaint has been redressed.

Summary

The High Court of Allahabad was hearing a contempt application filed by Naresh Kumar against Ramchandra Mishra and another. The contempt petition arose from a prior writ order dated 22 December 2017, which directed the Bar Council of Uttar Pradesh to decide the petitioner's complaint within three months. The opposite party contended that the Bar Council had complied with the writ order in 2019, and after a review, the committee finally issued a decision on 24 March 2025, thereby redressing the complaint. The Court examined whether the complaint had indeed been resolved and whether any contempt had occurred. Finding that the complaint was fully addressed, the Court held that there was no ground for contempt. Consequently, the contempt application was dismissed as infructuous and the contempt notice was discharged.

                                                        HON'BLE ROHIT RANJAN AGARWAL, J.

                                    1. The writ Court on 22.12.2017 while disposing of Writ-C No. 62311 of
                                    2017 had passed the following order;

"Considering the facts and circumstances that has been brought on record,
we dispose of the matter directing the Bar Council of Uttar Pradesh to
decide the complaint of the petitioner within three months from the date
of production of a certified copy of this order."

                                    2. Learned counsel for opposite party states that earlier order of writ
Court was complied in the year 2019 but a review was filed in the matter
and the committee, thereafter, on 24.3.2025 had passed an order deciding
the complaint and complying the order of writ Court, copy of the decision
taken by the committee has been placed before the Court, which is taken
                                    on record.

                                    3. In view of the said fact as complaint has been redressed by the
committee, no case for contempt is made out. Contempt application
stands dismissed as infructuous. Contempt notice stands discharged.

                                                                                                  (Rohit Ranjan Agarwal,J.)
