Holding
The court held that substantial compliance with the writ order existed, so the contempt application was consigned to the record.
Summary
M/s Puneeta Food and Firms Pvt Ltd filed a contempt application alleging willful defiance of a September 9, 2025 order in Writ Tax No. 3826 of 2016. The opposite party submitted a compliance affidavit stating that the principal amount of Rs. 2,80,100 was paid by RTGS/NEFT and that interest of Rs. 1,07,880 was paid for a delay of 782 days at 18% per annum. The court examined the affidavit and found that there was substantial compliance with the writ court's order. Consequently, the contempt application was consigned to the record and the notices were discharged, leaving the petitioner free to challenge the quantum of interest before the appropriate forum. The matter was thus closed without a finding of contempt.
Issues considered
- Whether the opposite party's compliance affidavit amounts to sufficient compliance with the writ court's order, thereby negating contempt.
