Allahabad High Court

ANITA MISHRAversusSAURABH KUMAR PANDEY

Decided

Holding

Although a prima facie case of contempt exists for willful disobedience of the order, the court adjourned the matter and granted the opposite party three months to comply before proceeding.

Summary

Anita Mishra filed a contempt application under Section 12 of the Contempt of Courts Act, alleging that Saurabh Kumar Pandey willfully disobeyed the High Court's order dated 03.11.2025 in Writ Petition No.15906 of 2025. The order had been personally served on the opposite party on 17.11.2025, but compliance was not forthcoming. The court found that a prima facie case of contempt existed but, without issuing a notice, granted the opposite party an additional three months to comply. The applicant was directed to provide stamped envelopes for service of the order, and the court ordered that the opposite party must comply and inform the applicant within a week of receipt. If compliance fails, the applicant may approach the court again. The application was disposed of at this stage.

Issues considered
