Allahabad High Court

ANJANEE KUMAR KUSHWAHAversusMR. RAJEEV YADAV, TEHSILDAR, TEHSIL SADAR

Decided

Holding

The court held that although a prima facie case of contempt exists, no contempt order is made; instead, the opposite party is given three months to comply with the original order.

Summary

The applicant filed a contempt application under Section 12 of the Contempt of Courts Act, alleging that the opposite party willfully disobeyed a judgment dated 28‑08‑2023 in Writ Petition No.1984 of 2023. The order was served on the opposite party on 22‑09‑2023, but compliance was not forthcoming. The court found a prima facie case of contempt but, noting that no notice had been issued, refrained from imposing punishment. Instead, the court granted the opposite party an additional three months to comply, directing the applicant to provide stamped envelopes for service of the order. The court ordered that the opposite party must comply and inform the applicant within a week of receipt, and left open the possibility of a fresh contempt application if compliance fails. The application was therefore disposed of at this stage.

Issues considered

  • Whether the opposite party's failure to comply with the court's order amounts to contempt under Section 12 of the Contempt of Courts Act
  • Whether notice is required before proceeding with contempt proceedings
