Allahabad High Court

RAM BILAS SINGHversusMANISH KUMAR VERMA, DISTRICT MAGISTRATE

Decided

Holding

The court held that, although a prima facie case of contempt existed, it would not issue a notice and instead provided the opposite party a further three‑month period to comply with the original order.

Summary

The applicant, Ram Bilas Singh, filed a contempt application under Section 12 of the Contempt of Courts Act seeking punishment of the opposite party, District Magistrate Manish Kumar Verma, for willful disobedience of a judgment dated 04‑11‑2025 in Writ Petition No.11355 of 2025. The court noted that a copy of the order had been served to the opposite party on 21‑11‑2025 but remained unimplemented. While prima facie a case for contempt existed, the court declined to issue a notice and instead granted the opposite party an additional three months to comply, subject to procedural steps involving stamped envelopes. The applicant was directed to provide the necessary envelopes within a week, after which the court would forward the order to the opposite party. The court further ordered that the opposite party must comply and inform the applicant within a week of receipt, failing which the applicant may approach the court again. The contempt application was therefore disposed of pending compliance with the original order.

Issues considered

  • Whether the opposite party's failure to comply with the order dated 04‑11‑2025 constitutes willful disobedience punishable under Section 12 of the Contempt of Courts Act
  • Whether a notice should be issued before proceeding with contempt proceedings
