Holding
A prima facie case of contempt exists, but the Court refrains from issuing a notice and instead grants the opposite party time to comply, disposing the contempt application at this stage.
Summary
The applicant, Pramod Kumar Batham, filed a contempt application under Section 12 of the Contempt of Courts Act against Raj Kumar Pandit for allegedly willfully disobeying the High Court's order dated 11‑12‑2025 in Writ Petition No. 18729 of 2025. The order was served to the opposite party on 23‑12‑2025, but compliance was not forthcoming. The Court observed that a prima facie case of contempt existed but chose not to issue a notice at this stage. Instead, it granted the opposite party three months to comply with the order and prescribed a procedure for service of the order via registered envelopes. The Court directed the applicant to provide the necessary envelopes and held that if compliance is not achieved, the applicant may approach the Court again. The contempt application was therefore disposed of pending compliance.
