Allahabad High Court

BHIKHARI DECEASED AND ANOTHERversusRAM SAJAN AND 2 OTHERS

Decided

Holding

No contempt as there is no specific finding of violation of the status‑quo order.

Summary

In 2002 the writ court issued a status‑quo order in a land dispute. In 2026 the respondents filed a contempt application alleging that the order had been violated and that they had been dispossessed of the land. The High Court examined whether there was any specific finding showing a breach of the status‑quo order. It held that the order had been in force since 2002 and no clear determination of possession existed, so no contempt could be established. The Court suggested that if the applicant was aggrieved, the interim order could be modified, but the contempt petition itself was unfounded and was dismissed.

Issues considered

  • Whether the alleged dispossession constitutes a violation of the 2002 status‑quo order attracting contempt
  • Whether the contempt application is maintainable in the absence of specific findings on possession

Subjects

  • contempt
  • status quo
  • land dispute
  • interim order
  • writ petition

                                    Court No. - 9
                                                    HON'BLE ROHIT RANJAN AGARWAL, J.

                                    1. The writ Court on 07.12.2002 in the writ petition filed by the opposite
party had passed an order of status quo.

                                    2. Present contempt proceedings have been initiated by the respondents in
the writ petition on the ground that the interim order has been violated
and they have been dispossessed from the land in dispute.

                                    3. As the order of status quo was operating since 2002, no case for
contempt is made out as there is no specific findings as to who was in the
possession over the land in dispute. In case, the applicant is aggrieved, he
may get the interim order modified.

                                    4. Contempt application is misconceived and the same stands dismissed.

                                                                                   (Rohit Ranjan Agarwal,J.)
