Allahabad High Court

M/S JAI BAJRANG ENTERPRISESversusVANDANA VERMA AND ANOTHER

Decided

Holding

The court held that while a prima facie case of contempt exists, the matter should be deferred and the opposite parties given time to comply before any contempt notice is issued.

Summary

The applicant, M/s Jai Bajrang Enterprises, filed a contempt application under Section 12 of the Contempt of Courts Act alleging that the opposite parties, Vandana Verma and another, willfully disobeyed a judgment and order dated 27‑01‑2026 issued in Writ Petition No.43316 of 2025. The order was served on 05‑02‑2026 but remained unimplemented. The court found a prima facie case of contempt but, noting procedural requirements, declined to issue a notice at this stage. Instead, it granted the opposite parties three months to comply with the order and directed the applicant to provide stamped envelopes for service of the order and contempt application. The opposite parties were instructed to comply and inform the applicant within a week of receipt, with a further opportunity for the applicant to approach the court if compliance fails. The application was ultimately disposed pending compliance.

Issues considered

  • Whether the opposite parties are in contempt for willful disobedience of the order dated 27‑01‑2026 under Section 12 of the Contempt of Courts Act
