Allahabad High Court

CHANDRA MOHAN SINGHALversusDR. ASHISH KUMAR GOEL, CHAIRMAN, UTTAR PRADESH POWER CORPORATION LIMITED, SHAKTI BHAWAN, 14 ASHOK M

Decided

Holding

A prima facie case of willful disobedience exists, but the court refrains from proceeding with contempt and instead grants the opposite party further time to comply.

Summary

The applicant, Chandra Mohan Singhal, filed a contempt application under Section 12 of the Contempt of Courts Act alleging that the opposite party, Dr. Ashish Kumar Goel, willfully disobeyed a judgment dated 24‑04‑2025 in Writ Petition No.14119 of 2024. The order was served on the opposite party on 28‑05‑2025, but compliance was not forthcoming. The court found a prima facie case of contempt but, noting that no notice had been issued, directed the parties to exchange stamped envelopes to facilitate service of the order and granted the opposite party an additional three months to comply. The court further instructed that if compliance is not achieved, the applicant may approach the court again. Consequently, the contempt application was disposed of at this stage without any penalty.

Issues considered

  • Whether the opposite party’s failure to comply with the order dated 24‑04‑2025 amounts to willful disobedience punishable under Section 12 of the Contempt of Courts Act.
