Allahabad High Court

RAM BHOOL SINGHversusDR HARENDRA SINGH

Decided

Holding

While a prima facie case of contempt exists, the court deferred contempt proceedings and granted the opposite party time to comply with the original order.

Summary

The applicant filed a contempt application under Section 12 of the Contempt of Courts Act, alleging that the opposite party willfully disobeyed the High Court's order dated 11‑11‑2025 in Writ Petition No. 16739 of 2025. The order had been served to the opposite party on 04‑12‑2025, but compliance was not forthcoming. The court observed that a prima facie case of contempt existed but declined to issue notice at this stage. Instead, it granted the opposite party an additional three months to comply with the original order and directed procedural steps for serving the order again. The court further ordered that if compliance is not achieved, the applicant may approach the court again. The contempt application was therefore disposed of pending compliance.

Issues considered

  • Whether the opposite party's failure to comply with the order constitutes contempt under Section 12 of the Contempt of Courts Act.
  • Whether notice should be issued and contempt proceedings should be initiated at this stage.
