Allahabad High Court

KARANI DEVIversusSHRI PRAVEEN MISHRA

Decided

Holding

A prima facie case of contempt exists, but the court refrains from issuing a contempt notice, instead granting the opposite party time to comply and disposing of the application pending compliance.

Summary

The applicant, Karani Devi, filed a contempt application under Section 12 of the Contempt of Courts Act alleging that the opposite party, Shri Praveen Mishra, willfully disobeyed the High Court’s order dated 19‑12‑2025 in Writ Petition No. 43855 of 2025. The order had been served on the opposite party on 22‑12‑2025, but the court found that it had not been complied with. While the court recognized a prima facie case of contempt, it declined to issue a notice at this stage and instead granted the opposite party three months to comply, directing procedural steps for service of the order. The opposite party was instructed to comply and inform the applicant within a week of receipt. The court held that if compliance is not achieved, the applicant may approach the court again. Consequently, the contempt application was disposed of without a contempt finding.

Issues considered

  • Whether the opposite party’s failure to comply with the order dated 19‑12‑2025 amounts to contempt of court under Section 12 of the Contempt of Courts Act.
  • Whether the court should issue a notice of contempt at this stage or grant time for compliance.
