Allahabad High Court

SAMEERversusDR PAWAN KUMAR ARUN AND 3 OTHERS

Decided

Holding

A prima facie case of contempt exists, but the court adjourns the matter, granting the opposite party time to comply before any contempt proceedings are pursued.

Summary

The applicant filed a contempt application under Section 12 of the Contempt of Courts Act, alleging that the opposite party willfully disobeyed the High Court's judgment and order dated 18 September 2025 in Writ Petition No. 14061 of 2025. The order was served on the opposite party on 29 September 2025, but the court found that the party had not complied. While the court recognized a prima facie case of contempt, it did not issue a notice at this stage. Instead, it granted the opposite party three months to comply with the order and directed the applicant to provide stamped envelopes for service of the order and contempt application. The opposite party was instructed to comply and inform the applicant within a week of receipt. The court held that if compliance is not achieved, the applicant may approach the court again, and the contempt application was disposed of for the time being.

Issues considered

  • Whether the opposite party's failure to comply with the High Court's order constitutes willful disobedience punishable as contempt under Section 12 of the Contempt of Courts Act.
