Holding
The court found a prima facie case of contempt but deferred notice, granting the opposite party three months to comply and disposing of the application at this stage.
Summary
The applicants filed a contempt application under Section 12 of the Contempt of Courts Act, alleging that the opposite party willfully disobeyed the High Court's order dated 12 September 2025 in Writ Petition No. 14902 of 2021. The order was served on the opposite party on 10 October 2025, but the court found that it had not been complied with. While the court recognized a prima facie case of contempt, it chose not to issue a notice at this stage and instead granted the opposite party three months to comply with the order. The court directed the applicants to provide stamped envelopes for service of the order and required the opposite party to acknowledge compliance within a week of receipt. The application was disposed of pending compliance, with the applicants free to approach the court again if the order remains unfulfilled.
Issues considered
- Whether the opposite party's failure to comply with the order constitutes contempt under Section 12 of the Contempt of Courts Act
