Allahabad High Court

JAGRITI NIGAMversusSMT J REEBHA

Decided

Holding

The court held that no case for contempt arose from the order and dismissed the contempt application.

Summary

Jagriti Nigam filed a civil contempt application against Smt J Reebha, challenging an order dated 23 September 2025 in Writ‑A No. 14376 of 2025 that dealt with the petitioner’s reversion from a Group ‘C’ to a Group ‘D’ post and the scheduling of a typing test. The High Court examined the order and found that it did not contain any act of disobedience or scandalous contempt of the court. Consequently, the court held that no case for contempt existed. The contempt application was therefore dismissed as misconceived. The decision was delivered on 5 May 2026 by Justice Rohit Ranjan Agarwal.

                                                    HON'BLE ROHIT RANJAN AGARWAL, J.

                                    1. Perused the order dated 23.09.2025 passed in Writ-A No. 14376 of 2025,
                                    which reads as under:-

"It is argued by learned counsel for the petitioner that petitioner's
appointment as a group 'C' employee has been cancelled and she has
been reverted to the position as group 'D' post having failed in typing test
which was suddenly taken by the respondents without giving her requisite
                                         time for preparation.
In the given facts and circumstances, while petitioner has been reverted
to the position of group 'D' employee, it is hereby provided that she shall
continue to enjoy lien on the group 'C' post and hence no fresh
appointment shall be made on that post until the next typing test is held.
The next typing test of the petitioner shall be held in the first week of
December, 2025 and petitioner's result of typing test shall be placed
before the Court in a sealed cover on the next date fixed.
                                         List on 10th December, 2025.
Sri Vishal Singh, learned Standing Counsel shall communicate this order

                                    3. The contempt application is misconceived and stands dismissed.

                                    May 5, 2026
