Allahabad High Court

CHANDRA PRAKASH AGARWALversusAJEET KUMAR SINGH AND 2 OTHERS

Decided

Holding

A prima facie case of contempt exists, but the court adjourned the matter, granting the opposite party three months to comply before any further contempt proceedings.

Summary

The applicant filed a contempt application under Section 12 of the Contempt of Courts Act, alleging that the opposite party willfully disobeyed the judgment and order dated 20‑03‑2026 in Writ Petition No. 10684 of 2026. The order was served on the opposite party on 24‑03‑2026, but the court found that compliance had not been achieved. While the court recognized a prima facie case of contempt, it declined to issue a notice at this stage and instead granted the opposite party three months to comply with the order. The court directed the applicant to provide stamped envelopes for service of the order and contempt application, and instructed the court office to forward these documents to the opposite party. The opposite party was ordered to comply with the writ court’s directions and inform the applicant within a week of compliance. The court held that if compliance is not achieved, the applicant may approach the court again, and the contempt application was disposed of for the time being.

Issues considered

  • Does the opposite party's failure to comply with the order dated 20‑03‑2026 amount to contempt of court under Section 12 of the Contempt of Courts Act?
  • Should a notice be issued to the opposite party before proceeding with contempt proceedings?
