Allahabad High Court

MEDICAL POLLUTION CONTROL COMMITTEEversusDR. PAVAN KUMAR ARUN, DIRECTOR GENERAL, MEDICAL AND HEALTH SERVICES, SWASTH BHAWAN, KAISAR BAGH, LU

Decided

Holding

The court declined to issue notice and instead granted the opposite party three months to comply with the earlier order, disposing of the contempt application at this stage.

Summary

The Medical Pollution Control Committee filed a contempt application alleging that Dr. Pavan Kumar Arun, Director General of Medical and Health Services, willfully disobeyed the High Court’s order dated 17 May 2025 in Civil Misc. Writ Petition No. 14782 of 2025. The order had been served on 27 May 2025 but remained unimplemented. The court found a prima facie case of contempt but, instead of issuing a notice, granted the opposite party an additional three months to comply with the original order. The court directed the applicant to provide stamped envelopes for service of the contempt application and ordered the court’s office to forward the copy of the order to the opposite party. The opposite party was instructed to comply and inform the applicant within a week of receipt. If compliance fails, the applicant may approach the court again. The contempt application was therefore disposed of at this stage.
