Allahabad High Court

OM JIversusAJAY ANAND VERMA AND 3 OTHERS

Decided

Holding

The court held that while a prima facie case of contempt existed, the opposite parties were given a further three months to comply before any contempt proceedings could proceed.

Summary

The applicant filed a contempt application alleging that the opposite parties willfully disobeyed the High Court's order dated 27 January 2026 in Civil Misc. Writ Petition No. 908 of 2026. The order had been served on 28 January 2026 but remained unimplemented. The court observed that a prima facie case of contempt existed but, without issuing a notice, granted the opposite parties an additional three months to comply with the order. The court also directed the applicant to provide stamped envelopes for service of the order and contempt application to the opposite parties. The opposite parties were instructed to comply with the writ court's directions and inform the applicant within a week of compliance. The court held that if compliance is not achieved, the applicant may approach the court again, and the contempt application was disposed of at this stage.
