Allahabad High Court

SANJAY YADAVversusSMT ARCHANA AGRAWAL

Decided

Holding

The court held that no contempt finding could be made at this stage and granted the opposite party additional time to comply, disposing of the contempt application.

Summary

The applicant, Sanjay Yadav, filed a contempt application alleging that the opposite party, Archana Agrawal, willfully disobeyed the High Court's order dated 20‑01‑2026 in Civil Misc. Writ Petition No. 533 of 2026. The order had been served on 09‑03‑2026, but the opposite party had not complied. The court observed that a prima facie case of contempt existed but, consistent with procedural requirements, it did not issue a notice at this stage. Instead, the court granted the opposite party an additional three months from the date of production of a certified copy of the order to comply, and directed the applicant to provide stamped envelopes for service of the order. The court further directed that if compliance is not achieved, the applicant may approach the court again, and disposed of the contempt application pending compliance.

Issues considered
