Allahabad High Court

PAWAN DEEP SINGHversusMR. SANJAY PANDEY AND ANOTHER

Decided

Holding

The court did not find the opposite party in contempt at this stage and granted further time for compliance, disposing of the contempt application.

Summary

The applicant filed a contempt application alleging that the opposite party willfully disobeyed the High Court's order dated 9 January 2026 in Civil Misc. Writ Petition No. 168 of 2026. The order had been served on 16 January 2026 but had not been complied with. The court observed that a prima facie case of contempt existed but, without issuing a notice, it granted the opposite party an additional three months to comply with the order. The court directed the applicant to provide stamped envelopes for service of the order and contempt application to the opposite party. The opposite party was instructed to comply with the writ court's directions and inform the applicant within a week thereafter. The court disposed of the contempt application at this stage, leaving open the possibility of a fresh application if compliance is not achieved.
