Allahabad High Court

MANTI DEVIversusPARIKSHIT KHATANA, CHIEF DEVELOPMENT OFFICER

Decided

Holding

The court did not find contempt at this stage but granted the opposite party a further three months to comply with the order.

Summary

The applicant, Manti Devi, filed a contempt application under Section 12 of the Contempt of Courts Act alleging that the opposite party, Parikshit Khatana, willfully disobeyed a judgment dated 25 September 2025 in Writ Petition No. 29446 of 2025. The order was served on the opposite party on 21 January 2026, but compliance had not been achieved. The court found a prima facie case of contempt but, instead of issuing a notice, granted the opposite party an additional three months to comply after a certified copy of the order is sent. The applicant was directed to provide stamped envelopes for service, and the court ordered the opposite party to inform the applicant of compliance within a week thereafter. The court held that if compliance is not achieved, the applicant may approach the court again, and the contempt application was disposed of at this stage.

Issues considered

  • Whether the opposite party's failure to comply with the order dated 25‑09‑2025 constitutes willful disobedience punishable as contempt under Section 12 of the Contempt of Courts Act.
