Allahabad High Court

DEEPAK KUMAR DWIVEDIversusPREM PRAKASH, EXECUTIVE ENGINEER, ELECTRICITY DISRIBUTION DIVISION-III, CIVIL LINE, MORADABAD

Decided

Holding

The contempt application was dismissed as the writ court's order had been complied with.

Summary

The Division Bench on 29 July 2024 set aside a final assessment order dated 25 April 2024 and its recovery, directing the opposite party to reconsider the applicant's objections. The opposite party filed an affidavit stating that a reasoned order addressing those objections was issued on 18 August 2025, and the order was attached as Annexure 1. The applicant then filed a contempt application alleging non‑compliance with the writ court's order. The court examined the affidavit and found that the writ court's order had indeed been complied with. Consequently, the contempt application was deemed infructuous and was dismissed, with the contempt notice discharged.

                                    Court No. - 9
                                                    HON'BLE ROHIT RANJAN AGARWAL, J.

                                    1. The Division Bench on 29.07.2024 had quashed the final assessment order
dated 25.04.2024 and consequential recovery. The opposite party was to
decide the matter afresh on the objections of the applicant.

                                    2. In the affidavit of compliance, in paragraph 4, it has been stated that the
objections have been decided by a reasoned order on 18.08.2025, copy of
which, has been brought on record as Annexure 1 to the said affidavit.

                                    3. In view of said fact, as the order of writ Court has been complied with,
present contempt application is rendered infructuous and the same stands
                                    dismissed.

                                    4. Contempt notice stands discharged.

                                                                                     (Rohit Ranjan Agarwal,J.)
