Allahabad High Court

SUKHNANDAN SINGHversusMRS NISHA ASTHANA,DISTRICT INSPECTOROF SCHOOLS

Decided

Holding

The contempt application is dismissed as infructuous because the order of the writ court has been complied with.

Summary

The High Court, while disposing of Writ-A No. 13515 of 2023 on 17 August 2023, directed the opposite party to decide upon the applicant's claim. The opposite party filed a compliance affidavit on 2 July 2024 stating that the decision was made on 26 June 2024, attaching the decision as annexure. The applicant then filed a contempt application (Civil) No. 3285 of 2024 alleging non‑compliance. The Court examined the compliance affidavit and found that the earlier order had indeed been complied with. Consequently, the contempt application was held to be infructuous and was dismissed, with the contempt notice discharged.
