Allahabad High Court

ANIRUDH PRATAP SINGHversusHIMANSHU KUMAR, IAS, PRINCIPAL SECRETARY AND 2 OTHERS

Decided

Holding

The contempt application was dismissed as infructuous because the order directing payment of post‑retiral dues had been complied with.

Summary

The High Court, while disposing of Writ-A No. 11913 of 2023 on 17 October 2023, directed the opposite party to release the applicant's post-retiral dues. The opposite party filed a compliance affidavit on 5 September 2024, stating that the entire dues had been paid, attaching annexures as proof. The applicant then filed a contempt application alleging non‑compliance. The Court examined the affidavit and the annexures and found that the order had indeed been complied with. Consequently, the contempt application was held to be infructuous and was dismissed, with the contempt notice discharged.
