SMT. KAUSALYA DEVIversusSUSHIL KUMAR BHARTI, TEHSILDAR (JUDICIAL) TEHSIL BANSGAON

Decided

Holding

The contempt application is consigned to the record as it has outlived its utility.

Summary

The applicant, Smt. Kausalya Devi, filed a contempt petition alleging that the opposite party, Tehsildar Sushil Kumar Bharti, failed to comply with an order dated 18‑03‑2024 in Writ B No. 1107 of 2024, which required him to consider the applicant's application. The court noted that on 07‑09‑2026 a judgment had been reserved in the original writ proceeding, and the instructions related to that judgment were filed as Appendix‑B. In view of the pending judgment, the court held that the contempt petition had outlived its utility. Consequently, the contempt application was consigned to the record, leaving the applicant free to approach the court again if necessary. No substantive finding on contempt was made.
