Allahabad High Court
RADHEY SHYAM SINGHversusSHRI SURENDRA TIWARI PRESENTLY POSTED AS SECRETARY, BASIC EDUCATION PARISHAD
- Decided
- Bench
- VIKAS BUDHWAR
Holding
The contempt application is disposed of, directing the opposite party to transmit the applicant's representation to the designated committee, which must decide the matter within six weeks.
Summary
The applicant, Radhey Shyam Singh, filed a contempt application alleging that the Secretary, Basic Education Parishad, U.P., willfully defied the High Court order dated 03.12.2025 which directed the filing of a fresh representation and a decision within six weeks on his grievance regarding the selection of an Academic Resource Person (ARP). The Court examined the subsequent orders dated 07.07.2026, 04.08.2026, 21.08.2026, 14.09.2026 and 30.09.2026, noting that the opposite party had produced an internal order dated 02.09.2026 and the relevant Government Order of 22.10.2019 establishing a five‑member selection committee. The applicant claimed that despite filing the representation, the committee had not decided the matter, constituting contempt. The Court held that the opposite party must transmit the entire representation to the designated committee and that the committee should decide the issue within six weeks. The Court further directed that the applicant could approach the Court again if the matter remained unresolved. Consequently, the contempt application was disposed of with directions for compliance.
Issues considered
- Whether the opposite party willfully defied the High Court order dated 03.12.2025.
- Whether the failure to transmit the applicant's representation to the designated committee amounts to contempt.
- Whether the committee constituted under Government Order 22.10.2019 is the proper forum for deciding the grievance.
- Whether the court should enforce compliance with its earlier directive within a specified time‑frame.

response from the respondents, thus the passing of the order today may not be
construed to an expression that this Court has gone into the merits of the matter and
the second respondent shall accord independent consideration strictly in accordance
with law and the mandate of law holding the field."
3. This Court on 07.07.2026 proceeded to pass the following order:-

CAPL No. 3875 of 2026
7
