Allahabad High Court

RAM SWAROOPversusDR. ISHTIYAK AHMAD, C.M.O.

Decided

Holding

The contempt application is dismissed as infructuous because the writ order has been complied with.

Summary

The writ court directed Dr. Ishtiyak Ahmad, C.M.O., to decide the representation of Ram Swaroop, the applicant. The opposite party complied with this direction on 20 February 2023, as evidenced by an annexed compliance affidavit filed on 31 August 2024. The applicant then filed a civil contempt application (No. 3985 of 2024) alleging non‑compliance. The High Court examined whether the contempt petition remained viable after the compliance. Finding that the writ order had been fully satisfied, the Court held the contempt application to be infructuous and dismissed it, also discharging the contempt notice. The decision was pronounced on 23 April 2026 by Justice Rohit Ranjan Agarwal.

Issues considered

  • Whether the civil contempt application is maintainable after the opposite party has complied with the writ court’s order.

Subjects

  • civil contempt
  • writ compliance
  • contempt dismissal
