Allahabad High Court

SHANTI DEVI AND 2 OTHERSversusRAVI RANJAN, BRANCH MANAGER AND ANOTHER

Decided

Holding

The order of the writ court was deemed complied with, leading to the dismissal of the contempt application.

Summary

The applicants filed a contempt application alleging non‑compliance with a writ court order dated 24‑11‑2022 concerning an auction. The opposite party submitted a compliance affidavit and a discharge application, stating that the bank, unaware of the writ order, had conducted an e‑auction on 25‑06‑2024, subsequently cancelled it, and returned the auction proceeds to the purchaser on 18‑09‑2024. The court accepted the annexed letter from the Branch Manager confirming the cancellation and refund. Finding that the writ court's order had been complied with, the court dismissed the contempt application. Consequently, the bailable warrant issued in the matter was also discharged.
