Allahabad High Court

SMT. SUNEHRI DEVIversusSHIV PUJAN SINGH, FINANCE CONTROLLER, P.H.Q. (POLICE HEAD QUARTER), SHAHEED PATH, GOMTI NAGAR

Decided

Holding

The Court held that the contempt application is to be consigned to the record, with liberty to the applicant to question any unpaid amounts before the appropriate forum.

Summary

The applicant, Smt. Sunehri Devi, filed a contempt application alleging that the Uttar Pradesh Police Headquarters had willfully defied the High Court’s order dated 11 April 2017 which directed payment of family pension and permitted a fresh representation for her late husband’s post‑retirement dues. The Court noted that subsequent modification orders dated 27 January 2026 and 14 July 2026 required the respondent to process the pension and related benefits, which the applicant claimed were not complied with. The issues centered on whether the respondent’s failure to implement the orders amounted to contempt and whether the Court could entertain the contempt petition. After reviewing the record and the instructions issued on 8 September 2026, the Court found that the matter should be consigned to the record, granting the applicant liberty to raise any remaining payment issues before the appropriate forum. The Court recorded the contempt application and attached the instructions as Appendix A.

Issues considered

  • Did the respondent willfully defy the High Court’s order dated 11 April 2017 and subsequent modification orders?
  • Is the filing of a contempt application appropriate for the alleged non‑compliance?
  • What relief, if any, should be granted to the applicant regarding unpaid pension and post‑retirement dues?

Subjects

  • contempt
  • family pension
  • post‑retirement dues
  • Uttar Pradesh Police
  • non‑compliance
  • High Court order
  • civil contempt

Court No. - 53
                     HON'BLE VIKAS BUDHWAR, J.

1. The present contempt application has been preferred alleging willful
defiance of the order dated 11.04.2017 passed in Writ-A No. 30947 of 2016,
order whereof is quoted hereinunder.-

"The petitioner is widow of late Sri Raghuvir Singh, who was a Constable
in Civil Police. It appears that some criminal case, being Case Crime No.
226 of 1987, was pending against late Raghuvir Singh under Sections
     364, 302, 147, 148, 149, 210, 120 I.P.C. and 25/27/35 of the Arms Act. It
is stated that late Raghuvir Singh retired on 30th November, 2012 and in
view of the said case he was sanctioned only interim pension. Late
Raghuvir Singh preferred Writ-A No. 71422 of 2013, Raghuvir Singh v.
State of U.P. and others, for payment of retiral benefits which was
disposed of by this Court on 03rd January, 2014 by issuing a direction to
the Superintendent of Police, Hathras to consider his representation
within three months. In compliance thereof, Superintendent of Police has
passed the impugned order dated 12th May, 2014, wherein it has been
mentioned that since the criminal case is pending against him, he was not
     entitled for the pension.
Pending consideration of the criminal case, the husband of the petitioner
Raghuvir Singh unfortunately died on 03rd March, 2016.
It is contended on behalf of the petitioner that late Raghuvir Singh
unfortunately died on 03rd March, 2016, therefore, the criminal case
pending against him has now been abated. In view of the said fact, it is
further contended that late Raghuvir Singh was entitled for the benefit of
pension and the petitioner is entitled for the family pension.
I have heard Sri Sanjeev Kumar Pandey, learned counsel for the
petitioner, and Sri V.B. Yadav, learned Standing Counsel.
Concededly, the petitioner's husband was granted interim pension on the
ground that a criminal case was pending against him at the time of
sanction of the pension. Hence, vide order dated 30th November, 2012 he
was granted only interim pension. Now, after his death, the said criminal

                                           2

     case stood abated.
In view of the above, the writ petition is disposed of by issuing following
     directions:
     (1) The petitioner is entitled for the family pension. The respondents are
directed to issue necessary orders for payment of her family pension
without any loss of time expeditiously, preferably within two months from
the date of communication of this order.
     (2) With regard to payment of pension of late Raghuvir Singh, the
petitioner is at liberty to file a fresh representation before the newly
impleaded respondent no. 4 within three weeks. In the event any such
representation is made, the newly impleaded respondent shall pass an
order in accordance with law after furnishing opportunity to the
     petitioner.
     No order as to costs."

2. On 27.01.2026, the following orders were passed.-

     "Order on Modification Application
     1. Heard Sri Sanjeev Kumar Pandey, learned counsel for the petitioner and Ms. Archana
Tyagi, learned Standing Counsel for the State-respondents.
     2. The petitioner has filed the instant petition with the following prayer:
"i. To issue a writ or direction in the nature of mandamus directing to respondents to pay
family pension to the petitioner due to death of Raghuvir Singh, retired constable of Uttar
Pradesh Police, the husband of the petitioner.
ii. To issue a writ or direction in the nature of mandamus directing the respondents to pay
entire dues (pre and post retirement) of late constable retired Raghuvir Singh to the
petitioner within the time framed by this Hon'ble Court.
iii. To issue a writ or direction in the nature of cetiorari for quashing the order dated
     12.05.2014 passed by S.P. Hathras."
     3. The petition was disposed of vide order dated 11.04.2017. From perusal of the aforesaid
order, it is apparent that the retiral dues and pensionery benefits were withheld /partly
granted to the husband of the petitioner only because of the criminal case was pending
against the husband of the petitioner herein. Due to the death of the husband of the
petitioner subsequently the said criminal proceeding against the husband abated, meaning
thereby there was no conviction of the husband of the petitioner.
     4. In view thereof, submission of learned counsel for the petitioner is that the petitioner
was entitled to get all the retiral benefits of her husband along with the pensionery benefits
etc. By allowing the petition vide order dated 11.04.2017, this Court had directed the
respondents to grant the family pension to the petitioner without any delay and with regard
to the payment of pension of her husband, she was granted liberty to represent. However,
no direction was issued with regard to prayer no.II, which relates to the post retiral benefits
to the husband of the petitioner.
     5. In view thereof, the order dated 11.04.2017 is modified and the petitioner herein is
permitted to make a fresh representation with regard to prayer of post retiral dues of the
husband of petitioner within three weeks from today, which shall be considered by the
