Holding
The contempt petition is consigned to the record, allowing the applicant to challenge the later order in the appropriate forum.
Summary
The applicant, Narendra Kumar Singh, filed a contempt petition alleging that the District Magistrate, Mahender Singh Tawar, failed to comply with an order dated 1 December 2025 in Writ‑C No. 41123 of 2026, which required the magistrate to consider the applicant’s application. The court examined the record and noted that a subsequent order dated 12 August 2026 had been passed, scheduling the consideration of the applicant’s representation for 21 August 2026. The applicant’s counsel did not dispute the existence of this later order. The court directed that a copy of the instructions be served on the applicant’s counsel and held that the contempt petition would be consigned to the record, leaving the applicant free to challenge the later order in the appropriate forum. The instructions were taken on record as Appendix‑A.
Issues considered
- Whether the District Magistrate’s failure to act on the earlier order amounts to contempt of court
