Allahabad High Court

SRINATH AND 5 OTHERSversusSUDESH KUMAR SINGH AND 9 OTHERS

Decided

Holding

The contempt application was dismissed because the parties had complied with the interim order, making the application infructuous.

Summary

The High Court had earlier issued an interim order on 11 November 2022 directing the parties to maintain the status quo over a disputed land parcel (Gata No. 180). The parties filed a compliance affidavit on 25 September 2024 stating that no construction or other activity was being undertaken on the land and that the status quo was being observed. On this basis, the Court examined a contempt application filed by the petitioners alleging violation of the interim order. The Court found that the parties had fully complied with the interim order, rendering the contempt proceedings unnecessary. Consequently, the Court dismissed the contempt application as infructuous and discharged the contempt notice.

                                                     HON'BLE ROHIT RANJAN AGARWAL, J.

                                    1. An interim order was passed by the writ Court on 11.11.2022 in Writ-B

                                    2. In the compliance affidavit filed on 25.09.2024, in para nos. 9 and 10, it
has been stated that no construction work is going on in the disputed Gata
No. 180 and status quo is being maintained on the spot and none of the

                                    3. In view of said fact, as the order of writ Court has been complied with, the
present contempt application is rendered infructuous and stands dismissed.

                                    4. Contempt notice stands discharged.
