Allahabad High Court

BIJENDRA BAHADUR SINGHversusSRI RAJESH KUMAR VERMA, SDO

Decided

Holding

The Court held that substantial compliance with the earlier order, coupled with the pendency of a civil suit, precludes a finding of contempt and therefore consigned the contempt application to the record.

Summary

The High Court of Allahabad entertained a contempt application filed by Bijendra Bahadur Singh alleging that the Sub‑Divisional Officer, Tehsil Chunar, had failed to comply with the order dated 19.04.2024 in PIL No. 83 of 2024 directing a spot inspection and demarcation of alleged road encroachments on Arazi 212M and 373M. The opposite party submitted an affidavit stating that a spot inspection had been conducted, revealing that the land in question was barren and being used as a village road, with no encroachment, and that a civil suit (Civil Suit No. 443 of 2023) concerning the same land was pending with a status‑quo order. The Court examined the affidavit, the pending civil suit, and the fact that the officer had been transferred, concluding that there was substantial compliance with the earlier order. Consequently, the Court consigned the contempt application to the record, leaving it open for future proceedings if necessary. The bail and appearance of the opposite party before the Chief Judicial Magistrate were also noted. The judgment thus dismissed the contempt proceedings on the basis of substantial compliance and pending litigation.

Issues considered

  • Whether the Sub‑Divisional Officer violated the order dated 19.04.2024 in PIL No. 83 of 2024 by failing to conduct a spot inspection and demarcation of the alleged encroached road.
  • Whether the existence of a pending civil suit and a status‑quo order amounts to substantial compliance with the court's directive.
  • Whether contempt proceedings should continue against the opposite party.

Subjects

  • contempt
  • public interest litigation
  • land encroachment
  • spot inspection

4. This Court on 30.01.2024 sought instructions.
5. Pursuant thereto, orders were passed on 20.02.2024 and thereafter on
14.03.2024. After service of the copy of the instructions upon the learned
counsel for the writ petitioner, the learned counsel for the writ petitioner
has filed reply to the instructions dated 12.04.2024. A perusal of the
instructions under the signatures of Sub-Divisional Officer, Tehsil
Chunar, District-Mirzapur as received on 12.03.2024 would reveal that
in para 1 it is recited that Arazi No. 212M Rakba 0.719 hectares contains
six khatas para 2, it is asserted that Arazi No. 212M Rakba 0.719 hectare

6. Learned counsel for the writ petitioner has invited the attention
towards various documents contained in the reply to the instructions so
as to contend that without there being any proper demarcation and a
preparation of spot memo, it cannot be established that the pathway is
free from obstruction/encroachment. He submits that let a proper spot
inspection be done and a spot memo be done in the presence of the
villagers.
7. Shri Rajesh Kumar Tiwari, learned Additional Chief Standing Counsel
submits that though the instructions do not contain any spot memo,

the State Government/Gaon Sabha, an inspection will be conducted by the
competent authority in the presence of the villagers and thereafter if
necessary proceedings will be initiated as per the statute.

District-Mirzapur along with self attested copy of the writ petition, the
reply submitted to the instructions and the certified copy of the order

may not be construed to an expression that this Court has gone into the
     merits of the case.
     11. With the aforesaid observation, the writ petition is disposed off."
     5. This Court on 07.08.2024 proceeded to pass the following orders:
